Fee Schedule

MEDIATION RATES & CANCELLATION POLICY

RETENTION OF MEDIATION SERVICES

Mediation services are billed at a rate of $225 per hour per party for two parties, $175 per hour per party for three parties, and $125 per hour per party for four or more parties. Any time spent on preparation or post-mediation is billed at the same hourly rate. For clarity, a “party” is defined as all parties who are represented by the same counsel.

CANCELLATION POLICY

To avoid the minimum fee, cancellations or rescheduling requests must be made in writing no later than 5:00 PM EST, eight days prior to the mediation date. Cancellations or rescheduling requests received after this time will result in the minimum fee being charged, with the cost equally divided among all parties.

BILLING MATTERS

All fees are calculated based on the hourly rates above, and all invoices are due upon receipt. After the mediation concludes, each party will be billed for their portion of the fee, unless the parties agree otherwise. Payments must be made in accordance with the payment instructions on the invoice.

A Tip for Successful Mediation

The litigation process allows the parties to assess the strengths and weaknesses of their own and their adversaries’ cases. Once the parties agree to mediate, both parties should exchange all information that will be relied upon at mediation. Producing records, pictures, or any evidence for the first time at mediation makes it significantly more challenging for the parties to negotiate a settlement.

Marcia Davis is an accomplished attorney with decades of experience in civil litigation, mediation, and dispute resolution. A Florida Bar Board Certified Civil Trial Lawyer since 2006, Marcia has successfully tried more than 60 cases to verdict, representing both plaintiffs and defendants in high-stakes litigation. Notably, her work has extended to notable cases such as representing a local family in a wrongful death claim against a university hospital which led to the creation of the Sebastian Ferrero Foundation that improved pediatric services. Marcia’s professional affiliations and leadership roles highlight her significant contributions to both the legal and equine communities. She has served on the Judicial Nominating Commission for Florida’s Eighth Judicial Circuit, chaired the Paso Fino Horse Foundation, and served as president of the International Paso Horse Federation.
